Terms of Service

These Terms of Service ("Terms") govern your use of the Smart Club platform and services. By registering a club account or using Smart Club, you agree to be bound by these Terms.

1. Account Registration

To use Smart Club, you must register a club account using accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. Smart Club may be used only by clubs, organisations, and their authorised personnel.

2. Permitted Use

You may use Smart Club to manage your club's membership, finances, events, and communications. You agree not to:

• Use the platform for any unlawful purpose
• Attempt to gain unauthorised access to other clubs' data
• Reverse-engineer or attempt to extract the source code
• Use the platform to send spam or unsolicited communications
• Upload malicious code or files

3. Subscription and Billing

Paid plans are billed monthly in advance. Subscription fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension of your account.

4. Free Trial

We offer a 30-day free trial for Professional and higher plans. No credit card is required during the trial. At the end of the trial, your account will revert to the Starter (free) plan unless you choose to subscribe.

5. Data Ownership

You own all data that you enter into Smart Club. We process your data on your behalf and in accordance with our Privacy Policy. We do not claim any ownership rights over your club's data.

6. Service Availability

We strive to maintain 99.5% uptime but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance. We are not liable for losses resulting from service interruptions beyond our reasonable control.

7. Limitation of Liability

Smart Club is provided "as is". To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including loss of data, revenue, or business.

8. Termination

You may cancel your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your data will be retained for 90 days and then permanently deleted.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice with at least 14 days' advance notice. Continued use after the effective date constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of the Republic of Uganda. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kampala, Uganda.
